The Divorce Act refers to Access to your children when the other parent has primary residence of the children. However, if you were never married, then your interests are not set out under the Divorce Act, but under provincial legislation.  Under provincial legislation they use the term Parenting time (not Access).

 

Access to your children is your right when they reside primarily with their other parent.  Whether you are the parent with the primary residence or the access parent, I will discuss with you your personal circumstances and wishes.  We will determine what access arrangements will work best for you.  Then we determine how that access arrangement works best for the children and the other parent.

Mediation and Collaborative Law are very useful tool for arriving at an access schedule that takes into consideration everyone’s unique circumstances and what is best for the children.  An access plan that works for everyone (both parents and children) is the ultimate goal, as it fosters harmony in the relationship between parents and children and between parents.
